Version 2026-10-14 · Last updated 14 October 2026

1. Who sells to you. These terms apply when you buy a class, course or membership ("Product") from BreathAndRegulate d.o.o trading as BreatheRegulate, Kameni Zid 12, Split, 21000, Croatia, contact breatheregulate@gmail.com ("we"). We are the seller and the merchant of record for every Product we sell. Payments are processed by Stripe on our own Stripe account. Our storefront runs on Aikaya, a platform operated by Tenchi DWC-LLC, which is not a party to this sale and does not receive your payment; your Aikaya account is governed by the Aikaya Terms.

2. Acceptance. By buying or using a Product you agree to these terms.

3. What you get. A personal, non-exclusive, non-transferable licence to stream the Product through your Aikaya account for your own private, non-commercial use, for as long as you have access under these terms and the Aikaya Terms. A membership gives access to our library of recorded classes for each period you pay for; it includes no live or one-to-one access.

4. Prices, payment and renewals. Prices are shown before you pay, with any tax as shown at checkout. Your card statement shows the descriptor displayed at checkout. A membership renews automatically for the same period until you cancel. You can cancel at any time online in your Aikaya account (Account → Memberships), with effect from the end of the period you have paid for. If a Product has a free trial, its length and the price that follows are shown on its page and at checkout; you are reminded by e-mail at least 7 days before the first charge, or when the trial starts if it is shorter than 7 days, and you are not charged if you cancel online before the trial ends. A discount code we issue is applied at checkout, one code per order, has no cash value, and any expiry date or condition is shown before you pay. Card details are entered only on Stripe's checkout page.

5. Immediate access and withdrawal. Products are digital and streamed, not downloaded; once payment is confirmed the Product appears in your Aikaya Library and you receive a confirmation e-mail. Products are supplied immediately. At checkout you ask for immediate access and acknowledge that you lose the statutory 14-day right of withdrawal once supply begins.

6. Refunds. See our Refund Policy. 7. If something is wrong. If a Product does not match its description or does not play, contact us. You are entitled to have it fixed, or to a price reduction or refund, as the law provides.

8. Your use. You must not use a Product unlawfully; download, record, copy, share or resell it; let others use your account; use it for fraud or spam; infringe our or anyone's intellectual property; or interfere with the security of the Product or the platform (including malware, probing or scraping).

9. Intellectual property. We keep all rights in the Products. Nothing in these terms transfers them to you.

10. Availability. We aim to keep Products available but do not guarantee uninterrupted or error-free access. Aikaya commits to keep one-off purchases available for at least 12 months from purchase, as its Terms describe.

11. Suspension and ending access. We or Aikaya may suspend or end your access for a material or repeated breach of these terms, non-payment, or a risk of fraud or to security. A refund ends access to what it paid for. If you dispute a payment with your bank, access may be suspended while the dispute is reviewed.

12. Health and safety. Our classes are general education and practice for wellbeing. They are not medical, psychological or nutritional advice, diagnosis or treatment. Read the safety information in the Aikaya Terms (§10) before you practise, and stop if you feel unwell.

13. Liability. Nothing in these terms limits liability that the law does not allow to be limited, or your mandatory consumer rights.

14. Contact and complaints. breatheregulate@gmail.com. Please contact us before disputing a charge with your bank; a refund is quicker than a chargeback.

15. Law. These terms are governed by the law of Croatia. If you are a consumer, you keep the protection of the mandatory law of the country where you live and may bring proceedings there.
